General Terms and Conditions (GTC)

1 General/scope of application

Participation in face-to-face or online events (hereinafter "event" of Mehrwerk GmbH, Am Lenkwerk 5, 33609 Bielefeld (hereinafter referred to as "Mehrwerk" or "we") is exclusively on the basis of the following General Terms and Conditions (hereinafter "GTC") in the version valid at the time of registration. Unless expressly agreed in writing, deviating terms and conditions shall not apply. This shall also apply if Mehrwerk provides the service to the participant without reservation in the knowledge of the participant's terms and conditions of business or purchase. Individual, written agreements between Mehrwerk and the participant shall always take precedence. The offer to book tickets is directed exclusively at entrepreneurs within the meaning of Section 14 BGB (hereinafter referred to as "participant"). For the purposes of these GTC, these are natural or legal persons or partnerships with legal capacity who are acting in the exercise of their commercial or independent professional activity when concluding the contract with Mehrwerk. For reasons of better readability, the simultaneous use of the language forms male, female and diverse (m/f/d) is dispensed with. All personal designations apply equally to all genders.

2 Content and services/conclusion of contract

Registration by the participant is binding. The contract is concluded by sending the Get-your-Ticket newsletter on the website: www.mehrwerk.com/sfari. The participant is entitled to participate after acceptance of the order. The invoice will be issued after the event. Unless otherwise stated, the tickets purchased by the participant are personal and therefore non-transferable. Any resale or transfer of tickets is prohibited - with the exception of the provisions in section 5.1. Our event serves as a platform for networking and the exchange of experience among financial service providers.

3 Purchase price, discounts and payment

The ticket prices quoted are fixed prices plus VAT. The total purchase price is due after the event.

4. dispatch and complaint of tickets

Booked tickets will be sent by Mehrwerk to the e-mail address provided at the time of booking. After receipt of the ticket, the participant must check the correctness of the ticket himself in order to arrange for a replacement delivery in good time before the start of the event if necessary.

5. return of tickets, refund of the purchase price, postponements

Tickets may be canceled by the participant for a fee of 50% of the ticket price up to 45 days before the event. The nomination of a substitute participant from the registered company is possible at any time free of charge if the substitute participant is notified to Mehrwerk by e-mail. If an event is canceled by Mehrwerk, any ticket fees paid will be refunded. In the event that an event is postponed, the participant will be informed of this at the e-mail address he/she provided when booking.

6. photo and video recordings

In the context of events, photo and video recordings may be made by Mehrwerk or by commissioned third parties in which the participant is recognizable. The recordings serve Mehrwerk's own advertising purposes, in particular publication on the Internet (e.g. on the websites as well as social networks and video platforms in Mehrwerk accounts), at events and trade fair appearances by Mehrwerk, in the context of commercials and image films, for advertisements in affiliate links, in print media, on posters, on flyers as well as in electronic and postal advertising letters. Further information on data protection can be found on our website at www.mehrwerk.com/datenschutz.Mit. By booking a ticket and participating in the event, the participant agrees to the publication of the photos and videos in which he/she is depicted for the purposes stated in section 6.1. A recording of the event is not permitted.Mehrwerk stores and archives photo and video recordings in accordance with Section 6.1. in digital and/or analog form for its own documentation purposes as well as for proof and prosecution of any image rights violations committed by third parties.

7 Disclosure of data to third parties

After your registration for a Mehrwerk event, we may pass on your name, company and position to participants and partners in order to give them the opportunity to invite you to future events, but exclusively via Mehrwerk. Bringing together business contacts is the core objective of such a conference in the common interest and the disclosure of name, company and position is minimally invasive in the case of personal interests. Your other data will remain with us.

8 Data protection

If and insofar as the visitor has consented to this, the data provided by the visitor may also be used by the organizer for advertising purposes or transmitted to third parties (such as exhibitors). The visitor can revoke his consent to the organizer at any time (e.g. by e-mail to: s-fari@mehrwerk.com).

9 Liability of Mehrwerk

Mehrwerk excludes any liability for slightly negligent breaches of duty insofar as these do not concern essential contractual obligations (so-called cardinal obligations), damages resulting from injury to life, body or health or guarantees or claims under the Product Liability Act. Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose fulfillment the participant may rely. Moreover, Mehrwerk's liability towards entrepreneurs for the breach of material contractual obligations is limited to the amount of damage typically foreseeable at the time of conclusion of the contract. The same applies to breaches of duty by Mehrwerk's vicarious agents and legal representatives.

10. final provisions

Participants are not permitted to display or hand out advertising at the event venue without the express prior consent of Mehrwerk. In the event of infringement, the participant undertakes to pay a contractual penalty of EUR 5,000.00 to Mehrwerk. The participant will also be excluded from the event. Mehrwerk reserves the right to assert further claims for damages. These GTC are governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this contractual relationship shall be determined by the registered office of Mehrwerk. However, Mehrwerk is also entitled in all cases to bring an action at the general place of jurisdiction of the participant. Overriding statutory provisions, in particular regarding exclusive jurisdiction, remain unaffected. Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions of these GTC. Mehrwerk and the participant are obliged to replace the invalid provision with a valid provision that comes closest to the economic purpose of the invalid provision. The same applies in the event of a gap in the contract.
